罰則付きの規制、憲法上問題はないが

杉田敦・法政大教授 新型コロナウイルス対策として、政府は4月、特別措置法に基づく緊急事態宣言を出し、営業や外出の自粛を要請しました。今月に入り再び感染が広がっていることから、今度は自粛ではなく罰則付きの規制を求める声も出ていますが、経済活動や移動の自由を保障する日本国憲法との関係をどう考えたらいいでしょう。

長谷部恭男・早稲田大教授 憲法が求めているのは「権力的な手段は抑制的に使いなさい」ということで、特措法もそういう仕組みになっています。ただし、現憲法下では強制措置はとれないということではない。いわゆる「3密」のような、感染リスクが明らかに高い店を営業することは、そもそも憲法の保護の範囲外と考えられます。営業を禁止し、違反者に罰則を科しても憲法上は問題ありません。

杉田 明々白々に危険とまでは言えないような場合はどうですか。

長谷部 営業禁止は無理だとしても、たとえば、一度に入れる客数を罰則付きで制限することなどは可能でしょう。ただ、人は罰則があるから言うことを聞くわけではない。殺人がそう起きないのは殺人罪があるからではなく、みんなが人を殺すのはいけないと思っているからです。罰則や強制力の効果を強調しすぎるのはやめた方がいい

杉田 いまの憲法は国民の権利を制限できないから、改憲して緊急事態条項を設ける必要があると言っている閣僚もいますが。


It’s so sad that I needed to say sudden forever good-bye to my dear friend. She passed away a week ago. She was such a wonderful woman with golden heart, always kind to EVERYBODY. It is just amazing. We had so much good time, not only among friends but also in person. I’ll never forget her tenderness, friendly smile and generous goodwill. Thank you Pyrrah. You were so precious and significant in presence. I loved the word “mellow” you said when you talked about one of your daughter. I want to see her. I want to know who she is!




Pyrrah became more concentrated to her own project.


I’ve never imagined that it was the last outing with Pyrrah. She was with Tanya. She looked a bit weaker than before, but looked fit and OK. They bought a big Miura radish at the farm and asked me how to cook. We had such a intimate good time together, then said good-bye when they changed the train to Yokosuka. I did not want to say forever “sayonara” to her that day!!!

June 30th was David Joly’s birthday, I don’t know how old he is. I sent a birthday message to him via FB with a phrase of “I miss you!” David quickly reacted and said “I miss you, too.” We met about 12 to 15 years ago in Kamakura/ He stayed at our then Kamakura house in Hase for three days. It was such a fond memory, as he and other guy from XX were young, smart and funny. They were so nice in nature.

He is talking about how to plant squash in soft sweet voice, though I cannot understand any words in French, except “plastic!” and Gabriella’s “Merci beaucoup.”

I don’t know why he wore this on his birthday, but maybe protect himself from bugs in the field and from Covid 19!

The funniest conversation I remember was that he said his Japanese was MINUS 10 to 20, when I said my English was not good (or poor).

Covid-19 cases in South Sudan is alarming.

(2020.7.3) Covid-19 cases in South Sudan is alarming. People refuse to adhere to the rules laid down by the Ministry of Health. It stands at around 2007 confirmed positive cases, 38 deaths, 332 recovery, 1 in critical situation. 
The Government of Japan is building a bridge for us across the river Nile. We thank the kindness of the people and government of Japan towards us in South Sudan.

Corruption is rampant in South Sudan

JUBA – South Sudan’s parliamentary speaker has resigned after lawmakers threatened to impeach him for blocking efforts to fight corruption and mismanagement, local media reported Monday.

Anthony Lino Makana was accused by fellow MPs of failing to present auditor-general and anti-corruption reports to parliament and blocking lawmakers from summing ministers for questioning. He was also accused of approving a loan of $400 million (361 million euros) from Afrexim Bank without bringing it first to the house as recommended by law, in a motion tabled by lawmakers who demanded he resign. “The reason for tendering my resignation is an act of deep and sincere respect to your leadership (of the ruling SPLM party) for you requested me to do so,” Makana said in comments carried by South Sudan Broadcasting Radio on Monday. Corruption is rampant in South Sudan, which achieved independence in 2011 and plunged into civil war two years later.

On a scrap of paper in the archive is written
I have forgotten my umbrella. Turns out
in a pandemic everyone, not just the philosopher,
is without. We scramble in the drought of information
held back by inside traders. Drop by drop. Face

covering? No, yes. Social distancing? Six feet
under for underlying conditions. Black.
Just us and the blues kneeling on a neck
with the full weight of a man in blue.
Eight minutes and forty-six seconds.
In extremis, I can’t breathe gives way

to asphyxiation, to giving up this world,
and then mama, called to, a call
to protest, fire, glass, say their names, say
their names, white silence equals violence,
the violence of again, a militarized police
force teargassing, bullets ricochet, and civil
unrest taking it, burning it down. Whatever
contracts keep us social compel us now
to disorder the disorder. Peace. We’re out

to repair the future. There’s an umbrella
by the door, not for yesterday but for the weather
that’s here. I say weather but I mean
a form of governing that deals out death

Born in 1963 in Kingston, Jamaica, poet Claudia Rankine earned a BA at Williams College and an MFA at Columbia University. Rankine has published several collections of poetry, including Citizen: An American Lyric (2014), a finalist for the National Book Award and winner of the National Book Critics Circle Award in Poetry, the PEN Center USA Poetry Award, and the Forward poetry prize; Don’t Let Me Be Lonely: An American Lyric (2004); and Nothing in Nature is Private (1994), which won the Cleveland State Poetry Prize.
